These Terms of Service ("Terms") govern your access to and use of the Summer Games platform ("Service"), operated by Jet Fuel AI ("Company," "we," "us," or "our"), a business located in the State of California, United States.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's consent. By using the Service, you represent and warrant that you meet these requirements.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to keep it updated. You must notify us immediately of any unauthorized use of your account.

3. Organizations & Multi-Tenancy

The Service allows users to create or join organizations ("Orgs"). Organization administrators are responsible for managing their Org's membership, content, and settings. Each Org's data is logically separated; however, platform-level administrators may access Org data for support, moderation, and compliance purposes.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law;
Harass, abuse, threaten, or intimidate other users;
Upload or transmit content that is obscene, defamatory, or infringes intellectual property rights;
Attempt to gain unauthorized access to the Service, other accounts, or related systems;
Interfere with or disrupt the integrity or performance of the Service;
Use automated means (bots, scrapers) to access the Service without our written permission;
Misrepresent your identity or affiliation with any person or organization.

We reserve the right to suspend or terminate accounts that violate these rules, at our sole discretion and without prior notice.

5. User Content

You retain ownership of content you upload or create on the Service ("User Content"), including profile information, photos, chat messages, scores, and media. By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the Service.

You are solely responsible for your User Content. We do not endorse or guarantee the accuracy of any User Content and are not liable for any content posted by users.

6. Subscriptions, Payments & Pricing

The Service offers a free tier and a paid "Pro" subscription. Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge the payment method on file on a recurring basis until you cancel.

You may cancel your subscription at any time through the Manage Subscription portal. Upon cancellation, your Pro features will remain active until the end of the current billing period, after which your organization will revert to the free plan. No refunds are provided for partial billing periods.

Pricing changes.We are actively developing the Service and our pricing model is subject to change at any time. We reserve the right to change, modify, or discontinue any pricing tier, subscription plan, or feature at our sole discretion, with or without prior notice. Where practical, we will attempt to provide at least 30 days' notice of material price increases to active paying subscribers via email or in-app notification. Your continued use of a paid plan after a price change takes effect constitutes acceptance of the new pricing.

Free tier limits. The features and resource limits available on the free tier (including but not limited to member counts, event counts, game counts, and media storage) may be changed, reduced, or removed at any time. We reserve the right to enforce stricter limits or retire the free tier entirely with reasonable notice.

6a. Beta Services & Service Changes

The Service, or portions of it, may be offered in a beta or early-access state. Features may be added, modified, or removed without notice. We make no guarantees about the continued availability of any specific feature, integration, or pricing structure.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

7. Intellectual Property

The Service, including its design, code, logos, and documentation, is owned by Jet Fuel AI and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JET FUEL AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Jet Fuel AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

12. Termination & Data Deletion

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 5, 9, 10, 11, and 14.

Data retention and deletion. Upon account or organization deletion, or termination of your access to the Service, we reserve the right to delete all associated data (including but not limited to user profiles, event records, scores, media, and chat history) after a reasonable retention period, which may be as short as 30 days. We are not obligated to export or preserve your data following termination.

We further reserve the right to delete data associated with inactive accounts or organizations that have not logged in or had activity for an extended period (typically 12 months), with reasonable notice where possible. You are solely responsible for exporting any data you wish to retain before termination or inactivity-based cleanup occurs.

13. Modifications to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

15. General

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Jet Fuel AI regarding the Service.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
